I had a bit of bad start when the first conveyancer assigned to my sale left, and then so did the next one! Was then assigned to Danielle who was brilliant, if I was just writing the review for her it would be 5 stars!

I have waited 31 months before being able to write this review.

FW Meggitt trading as KMC Legal acted for me on the sale of a leasehold flat and the purchase of a freehold bungalow, completing on 26th January 2024. On that day I received a completion statement which was clearly incorrect. I pointed this out; I then received a second completion statement which was also incorrect. KMC calculated that they owed me £192 (which didn’t tally with either statement) and they paid this to me.

I attempted to put together my own completion statement, which was difficult as I couldn’t rely on the figures they had used, but I calculated they owed me around £1400. I sent this to them but received no response.

I then made a formal complaint to KMC under their own complaints procedure. Only after prompting did I receive an acknowledgment. I never received any response to my actual complaints.

I then referred it to the Legal Ombudsman. The Ombudsman wrote to KMC, who did not respond. In fact they failed to respond for such a length of time (over a year, I think) that the Ombudsman referred KMC to the Solicitors Regulation Authority.

The Ombudsman service makes it’s decisions purely based on the evidence you provide it, so I had to go through all my emails to/from KMC from 2023-2024; plus gather statements from my mortgage company, the managing agent and ground rent holder for the flat; plus copies of all bank statements for payments I had made to KMC. I put together a portfolio of evidence, which took me literally weeks.

One of my complaints from the beginning was that KMC had made me pay them (they said it was ‘standard procedure’) a £500 “retention” in case of arrears of service charge and ground rent even though I’d PROVED to them beforehand with statements from the managing agents that no such arrears existed (in fact I was owed money by the managing agent, the return of which KMC failed to apply for).

Another issue, which I was not aware of initially but which became clear when I was collating my evidence for the Ombudsman investigation, is that KMC’s completion statements had shown an incorrect mortgage redemption figure (for the amount I owed the building society to redeem the mortgage on my flat) stating I owed over £400 more than I actually owed. I checked with the mortgage company and they only received what was actually owed, not the additional £414 KMC’s statements said I owed, and which they retained until this matter was decided by the Ombudsman. What would have happened to that money if I had not pursued this matter??

Eventually, KMC engaged with the Ombudsman and some two and a half years after the start they made an offer of £1200 which I refused.

The Ombudsman continued his investigation based on my evidence and whatever KMC provided (I never got to see this). The Ombudsman found in my favour on all 5 heads of complaint and awarded me £1669. I decided to accept this rather than push it to the next stage as I was sick of the matter after all that time, although I think I deserved more for distress and inconvenience.

The Ombudsman’s decision is final and binding and KMC were to pay within 14 days, day 14 being 25.8.26. The final insult is that they paid a day late on 26.8.26, only after prompting by the Ombudsman, some 31 months after I completed on my sale and purchase.

I would warn anyone: DO NOT instruct this firm.
