Litige

Je pense ne pas être le seul dans cette situation. Evidemment, ma Datejust qui devait à la base m'étre renvoyée contre une somme de 100€ (qui ne correspond à on se sait quoi) ne sera finalement envoyée que la semaine prochaine. Finalement non, les locaux sont fermés en cette période, il faudra donc attendre début janvier. Bien évidemment, pour avoir débité mes 100€ ils ne sont pas en vacances...
J'entame donc ce jour une p)rocédure judiciaire en me rapprochant du tribunal de commerce de Paris. Tout témoignage complémentaire sera le bienvenu.

I bought a watch from them rolex 16550, and I got 16570, have been mailing them for days no answer at all, totally irresponsible, un professionnel seller, honestly stay away, the least they could do is answer my email plus they never answer the phone…. They just answered, and no one will believe what they said, they said we agree that we made a mistake but we can’t refund keep the watch the prices might go up 😳😳😳😳 what kind of company is it, only worlds most stupid people work in this company, really shocking

4 Tage vor dem Versand wurde meine Bestellung einfach ohne Absprache storniert, obwohl die Sendung bestätigt wurde. Einfach nur peinlich, unseriös und inkompetent. sie müssen sehr beschäftig sein, dass sie weder telefonisch noch per email erreichbar sind.

es tut uns aufrichtig leid, dass wir Ihre Bestellung stornieren mussten. Leider wurden wir auf Grund des vorläufigen Insolvenzverfahrens von Easycredit aus dem Partnerportal ausgeschlossen. Wir haben über die letzten zwei Wochen versucht Easycredit dazu zu bewegen, ausständige Bestellungen erfüllen zu dürfen. Leider ohne Erfolg. Hierzu hätten Sie eigentlich von Easycredit informiert werden müssen. Bitte entschuldigen Sie, dass dies nicht geschehen ist. Die von Ihnen gekaufte Uhr haben wir für den Verkauf reaktiviert. Why are buyers punished for this burglary?

What l don't get is buyers who placed order for watches the week of the 14th to 19th November but Watchmaster can't refund them and yet you are in operation to sell more watches? How do you guys sleep at night?

Dear Toese,

We would like to explicitly apologise to you for being one of the parties negatively impacted by the preliminary insolvency proceedings. Due to the theft that occurred on November 19th and the future revenues lost thereby we were instructed to file for preliminary insolvency.

Status Quo:
- Unfortunately, we have been instructed by the provisional insolvency administrator not to fulfil orders received before 19 November 2022.
- We are also not allowed to refund any of these orders, as these are unfortunately part of the insolvency mass.
- We have added all affected customers to the list of creditors.
- We have been instructed to sell the watch again. The sales proceeds will be included in the insolvency mass and will be used to fulfill the claims of all creditors.

We still hope to be able to avert insolvency in order to satisfy all customers in full.

We would like to advise you to seek legal advice.

Wahrscheinlich wird der…

Wahrscheinlich wird der Insolvenzverwalter die Zahlung der Versicherung einkassieren und der Insolvenzmasse zuschlagen. Es soll niemand glauben, dass die Versicherung, welche übrigens von Watchmaster nicht genannt wird, die versicherte Summe an die Kunden auszahlen wird.
Das ist alles ein Mega Betrug an den Kunden. Nur deswegen wurde Insolvenz beantragt.
Den Insolvenzverwalter freut es , denn es erhöht sein Einkommen.
Der Insolvenzverwalter gewinnt immer. So ist das System in dem wir leben.
Watchmaster wird wahrscheinlich sagen: Sorry wa, liegt nicht an uns der Insolvenzverwalter hat das Verfahren an sich gezogen. Es bleibt zu fragen, warum das Start Up so schnell Insolvenz eingereicht hat. War es schon vorher überschuldet? Immerhin machte die Klitsche seit Jahren 3-4 Millionen Euro Miese pro Jahr und wurde nur Dank Risikoinvestoren über Wasser gehalten.
Wer jetzt noch seine Uhr dort zum Verkauf einreicht, ist selber schuld. Wenn die verkauft wird, dann geht die Kaufsumme direkt in die Insolvenzmasse.

Sie sind natürlich zu Ihrer Meinung berechtigt, allerdings möchten wir an dieser Stelle hervorheben, dass die Intention der Versicherung der Schutz unserer Kunden war und ist. Unsere Versicherung hat darum gebeten, dass sämtliche Kommunikation zum Schadensereignis von uns übernommen wird. Bitte haben Sie Verständnis, dass wir dieser Bitte nachkommen, um die weitere Bearbeitung des Ereignisses möglichst reibungslos und effizient zu gestalten. Die oberste Priorität der Versicherung sollte die Bearbeitung des Schadensereignisses sein.
Ihre Mutmaßungen zum Vereinnahmung der Versicherungssumme seitens des Insolvenzverwalters teilen wir nicht.
Gerne möchten an dieser Stelle auch Ihrer Aussage bezüglich einer Überschuldung widersprechen. Das vorläufige Insolvenzverfahren wurde auf Grund einer negativen Fortführungsprognose gestellt. Zielsetzung ist es ganz klar die Insolvenz abzuwenden!
Wir müssen außerdem Ihrer Aussage widersprechen, dass der Verkaufserlös der noch bei uns gelisteten Uhren in die Insolvenzmasse eingeht. Dies ist faktisch falsch.
Wir verstehen und teilen Ihre Frustration, möchten Sie aber auch darauf hinweisen, dass Kommentare wie Ihre unser Vorhaben die Insolvenz abzuwenden gefährden und schlicht nicht hilfreich sind.

Watch stolen and they're providing very…

Watch stolen and they're providing very limited information for me to understand if I get paid back the insured value or information that I can use to submit a stolen watch online. They say that the watches are reported stolen, but when checking the online databases it's not there!

If you have your watch offered via their website, request it back before the Christmas holidays! They will probably file bankruptcy for the whole group and you'll miss your profits and watch.

We have communicated directly with each of the customers we have on file that have been impacted. We would happily take your call if you would like to discuss it directly.

We are in close contact with the insurance company as we work through the claim. They are still asking us to manage all communication surrounding the incident and resulting claim. Please understand that we are complying with this request in order to allow for the processing of the case by the insurers as smoothly and efficiently as possible. The insurance company's first priority should ultimately be to process the claim.

We have reported all of the watches to stolen to the stolen watch databases we work with and rely on in the course of our day to day business and of course the police.

The insolvency practitioners have recommended we continue to trade in order to improve our overall standing and make it most probable that we are in a position to repay all those affected by the insolvency process.

ARNAQUE vous ne verrez plus jamais votre bien

Non seulement ils se disent avoir été victime d'un vol (sans le démontrer) mais ils refusent de nous restituer notre montre ou de donner une preuve qu'elle n'a pas été également "volée?" Il faudrait procéder à une action légale contre ces gens au plus vite. L'union faisant la force, il faut attaquer le plus rapidement possible cette société et son représentant.

Hallo ich habe am 21.09.22 eine…

Hallo ich habe am 21.09.22 eine Breitling B2 bestellt und bezahlt 2750 € weil die Uhr nach Breitling zur Überholung geschickt wurde und danach mir ausgehändigt werden sollte ,musste vorher bezahlt werden ! Damit wurde sie mein Eigentum , sagt mein Anwalt. Die Uhr wurde am 21.11. 22 Von Breitling an Watchmaster zurück gegeben . Der Raub war vorher am 19.11.22 Hatte also mit meinen Eigentum nicht zutun. Mir wurde per e Mail geschrieben meine Uhr ist sicher und wird mir in kürze zugeschickt. Es wurde dann aber extra solange gewartet bis insolvent beantragt wurde. Dan bekam ich Bescheid es wird mir keine Uhr mehr zugeschickt und auch kein Geldrückgabe ! Alles mit e mail belegt. Mein Anwalt hat auf Aussonderrecht hingewiesen, dass mein Eigentum mir zugeschickt wird . Sollte das nicht klappen , werde ich Strafanzeige stellen , Weil mit der Rückgabe absichtlich solange gewartet wurde bis insolvent beantragt wurde ! Der Hammer ist ich werde durch e Mail aufgefordert eine Neue Uhr wieder zu kaufen , mit Rabat.

Status Quo:
- Leider wurden wir vom vorläufigen Insolvenzverwalter instruiert, Bestellung welche vor dem 19.11.2022 eingeganen sind nicht erfüllen zu dürfen.
- Auch einen Widerruf dürfen wir nicht durchführen, da diese Bestellungen leider als Forderung Teil der Insolvenzmaße sind.
- Wir haben alle betroffenen Kunden entsprechend zur Gläubigerliste hinzugefügt.
- Wir wurden instruiert die Uhr nochmals zu verkaufen. Die Verkauferlöse gehen in die Insolvenzmaße ein und dienen dazu die Forderungen aller Gläubiger zu bedienen.

Wir hoffen weiterhin die Insolvenz abwenden zu können umso alle Kunden ganz befriedigen zu können.

ABSOLUTELY UNBELIEVABLE!!!! I have ordered and paid for a watch. After that I become an confirmation email that they will prepare and send me the watch. Later they send an email saying they will not deliver me the watch, because they are bankrupt and they will also not refund me any money for my purchase since they declared bankruptcy later. IT HAS NOW BEEN TWO WEEKS LATER AND THIS ABSOLUTE PIECE OF WORK COMPANY HAS NOW RE-LISTED THE SAME EXACT WATCH FOR THE SAME EXACT PRICE, WITH THE SAME PHOTOS AND EVERYTHING AGAIN FOR SOMEONE ELSE TO BUY. ARE YOU SERIOUS??!!??!! DO YOU THINK THIS IS NORMAL?? IS THIS THE WAY YOU WANT TO CONDUCT BUSINESS? TAKING MONEY FROM PEOPLE, PROMISING THEM YOU SEND A WATCH AND THEN NOT SENDING ANYTHING, KEEPING THE WATCH AND THE MONEY MYSELF AND OTHER PEOPLE PAID, THEN RE-LISTING THE WATCH AND REPEAT THE WHOLE PROCESS AGAIN?? Disappointing Experience

They (UK) valued my Rolex, said it shouldn't take long to sell it at that price. They had it for 6months and then sent it back, I'm glad I went for 6month contract & not 12month. They were 100% confident they would sell it every time i contacted them once a month.

Heart was in my mouth when I saw the Bankruptcy news but I did get my watch back safely and on time.

In my view they should not share their website with a bankrupt German company selling watches

If part of their group declared Bankruptcy due to thefts then it calls into question their insurance situation & it takes a lot of trust to send someone your Rolex.

I have had the watch back for 1day and sold it to the first person that saw it, at more than Watchmaster were offering me.

In conclusion, The Rolex market fell in the time they had my watch but i feel they did not react quickly enough or keep me updated on the situation without some very heavy prompting.

They also tried to charge me over £100 for Servicing & over £100 for Polishing on a watch that hadn't been worn since a full £1,000 Rolex service the previous month. After a few angry phone calls they quashed the servicing charge.

So not a great risk reward ratio in my experience.

I am very pleased that you got your watch back free of charge as promised under your agreement with us. I am sorry for the refurbishment charges, these should not have been applied given your contract had expired and I have taken that up with the team to ensure it does not happen again.

I must say, we are decidedly disappointed to be unable to have found a buyer and were perhaps too aggressive with the sales price we were trying to achieve.
It has been a difficult market to operate in over the course of this year and I am sorry we were unable to react as swiftly as you would have thought appropriate, rest assured we are regularly monitoring the market and trying to keep our prices in line with and as close to the going rate as possible.

I am very please to hear you have found a buyer for your watch and I would like to take this opportunity to wish you every success in the future.

Einfacher, unkomplizierter Verkauf

Einfacher, seriöser Ablauf, schnelle, problemlose Abwicklung, kann man guten Gewissens weiterempfehlen, allerdings muss man sich im Klaren darüber sein, dass die Provision knapp 30% ausmacht.

Proche de l'arnaque

Cette société est régulièrement proche de l'arnaque.
Mon contrat de dépôt-vente arrive à expiration sans que la montre soit vendue : aucun souci.
On commence alors à m'expliquer que je devrai m'acquitter de frais de remise en état de 65 EUR. Or la montre a été livré neuve, jamais portée, et encore stickée...cela ressemble à une tentative d'arnaque.
Après m'être plaint, les frais sont supprimés.

Aujourd'hui, je souhaite le retour de ma montre. Alors qu'on me l'annonçait gratuit par mail il y a quelque jour, on me réclame aujourd'hui 60 EUR. Or, cette somme n'est ni inscrite sur le contrat de vente, ni inscrite sur la page des Terms & Conditions.
Lorsque que je pose la question, on m'annonce que la récente mise en procédure conservatoire de faillite empêche le retour gratuit, et ce contrairement au contrat précédemment signé.
Je ne peux qu'apporter mon soutien à l'entreprise et ses employés suite aux récents évènements, mais le fait que la société se dispense officiellement de respecter les contrats qu'elle a elle même édité et signé la place dans une totale illégalité.

Je lis depuis quelques jours plusieurs commentaires dénonçant plusieurs actes limites. Si des personnes souhaitent lancer une Class Action, je me joindrai à elles. Qu'elles n'hésitent pas à me contacter à antoine point fontana arobase gmail point com

company is bankrupt - avoid

Purchased a watch in early November. Watch was delayed in shipping. Then got an email about the robbery, and said my watch would still be shipped. My watch was never shipped and then got an email that I would not receive a refund OR the watch due to insolvency.

Their site is still up for business, you should avoid at all costs.

We are doing everything we can to firstly ensure we can bring the matter to a resolution as swiftly as possible.
We want provide our customers a meaningful update on next steps. This included who have entrusted us with the their assets and want them back or those that have paid for a product in good faith and want their money back.
Our fundamental objective is to find a route to make this right, and I think I speak for the entire team when I say we too want to understand that resolution. At this stage we must ask for your continued patience and cooperation. We will be in touch immediately with an update when we have one.

Please be aware that Watchmaster ICP Uk Ltd is unaffected by the events unfolding at Watchmaster in Germany and continues to trade. We are a separate entity but do still use the same website. I would like to offer our sincere condolences with all affected customer who were doing business with our GmbH counterpart and know that our colleagues in Germany are doing everything they can to understand how to bring this matter to a resolution.
