My Personal Experience with (redacted by request) at HK Law (Head of the Court of Protection Team) appointed ‘Deputy’ to the late Ilse Erna Trude Garrett, my mother.
Date of Experience August 2021 to 17th August 2022. Invoice £4000.
My journey with HK Law, particularly my interactions with Mr B, has been quite an ordeal. He was appointed by the Court of Protection (COP) as ‘Deputy’ to my late mother, Ilse, who passed away on 17th August 2022. The COP implied that he was respected, efficient and inexpensive. The experience has been the polar opposite. Be warned.
I had little option when my only sibling was pressing for my 90-year-old mother who had advanced-stage dementia, was deaf and blind and completely helpless to be removed from a care home and live at home. (without 24-hour supervision!) The court proceedings heard of dubious methods employed by my sibling and his wife to ensure they got their way by coercion. The only choice I had to protect my mother was to accept the court’s direction have our POA removed and have a ‘Deputy’ appointed to protect my mother’s welfare. Be assured Mr B did none of this.
Here are some points to consider:
-Mr B informed Barclays (my late mother’s bankers) that he was appointed Deputy only in March 2021 (The COP noted that my siblings had misappropriated over £5500 whilst the POA was active, leaving her account vulnerable to them for a further 6 months) He failed to pay my late mother’s creditors whilst ‘Deputy’. (Solicitors fees for the COP case!)
-Mr B arranged for the post to be redirected in October 2021 (a delay of 2 months)
-Mr B moved from his previous employers around December 2021 having made zero contact and no forwarding address. I tried to contact him but received no reply and wasn’t given contact details – he simply didn’t exist; he went missing for almost a year
-Mr B joined HK Law around March 2021, I believe.
-Mr B made first contact with me only in July 2021 with an email suggesting that he may well have cause to sell the house. (Since I live 80 miles from my mother’s former care home and have a chronic illness I needed the house to recuperate so this notice was shocking and upsetting)
-I met with Mr B in July 2021 a few weeks before my mother passed away. It was agreed that the house needed a valuation and that he would do it. I verbally informed him of an amount of money (a gift) made by my mother in 2012 to both sons. I explained fully in writing within two days. This was clearly explained and did not form part of her estate and would not affect inheritance tax. Another solicitor made the point that this was easily understood and basic information. He failed to understand and asked (at a later date) again and again, repeatedly. (more than five times!) He wrote in one email ‘…from memory I …’ This suggests he either DID NOT KNOW OR CARE ABOUT HIS BRIEF. Is this professional?
-Having received the valuations from three estate agents he gave the impression that instead of taking the mean average of the valuations (which is accepted practice, I believe) he could accept a much higher valuation preferred by my sibling! His assistant arranged the valuations. He failed to forward these and needed a few reminders. Eventually, I had to ask his assistant. This alone took weeks.
In summary, Mr B failed to check the mail, failed to administer the financial affairs, became invisible for almost a year, and (I believe) misapplied procedures concerning valuations and gifts about inheritance tax.
A request for further information to Mr B’s line manager and managing partner (concerning the invoice for this period) was ignored and only gained traction when I sent a reply I received from my local MP after I asked him for help. This is a separate episode but may be indicative of the delays that appear to be built-in at HK Law.
I will update this (if possible) when I have further information the situation is ongoing and has further chapters. I have written to my MP and will consider his advice as well as considering contacting The Law Society UK, the Chief Executive at His Majesty’s Courts & Tribunals Service (HMCTS), The Court of Protection (Dorset), the Office of the Public Guardian, Solicitors Regulation Authority and Legal Ombudsman. I am not happy.
In my opinion, a legal professional should provide clear, patient, and professional guidance, which overwhelmingly wasn't the case here.
I hope this helps you make an informed decision.

Sound advice and efficient service.
We had to register land and transfer a title to the previous landowners widow. The landowner had died some 20 years previously.
There was and issue with a small strip of land that had been pre registered. We received sound and clear advise and guidance through the process. The service was efficient and the price charged appropriate for the wok required.
